These Terms of Service (together with Supplemental Terms, defined below, "Terms of Service" or "Agreement") govern Your access to and Your purchase, receipt, and use of websites and other Services (defined in Section 1 below) that are provided or made available by USSurfs, LLC., on behalf of itself and its subsidiaries and affiliates (collectively "USSURFS", "we", "our" or "us").

The terms "You" and "Your" refers to the user or viewer of one of our Services.

By purchasing, accessing, receiving or using any Services, You affirm that (i) You are at least 18 years of age (or have reached the age of majority if that is not 18 years of age where You live) and You have reviewed these Terms of Service take full responsibility for Your compliance with them AND (ii) You are a legal resident of a country where Your access to and Your purchase, receipt and use of the applicable Services are permitted. You represent that You are fully able and competent to enter into the terms, conditions, and representations set forth in these Terms of Service, and You agree to abide by and comply with them.

Services; Your Account(s); Photosensitivity and Other Warnings

USSURFS offers a range of services over the internet or on PC, Mac, mobile and other devices, including, but not limited to, the following services:

(i) websites that provide free and paid options for advertising, promotional, branding, development, or design services, websites that offer information for entertainment purposes, community-oriented websites such as forums, message boards, chatrooms, IRC, social networks, blogs, blockchain, or groups (collectively, "Website(s)"),

(ii) software, games, and other products or services that You download, install, or simply use online as a service (sometimes referred to as "software as a service" or "SaaS"), including, but not limited to, USSURFS computer or mobile entertainment software game(s) (collectively, " Games") and do-it-yourself (DIY) promotional software,

(iii) access to Content, including, but not limited to, digital goods, digital products, digital services (such as website design, graphic design, or online promotions and branding), in-Game consumables, Downloadable Content and other digital items,

(iv) software, including, but not limited to, third-party software and small amounts of code that might be necessary to facilitate use of Services or playing online Games that are provided by USSURFS as a service offering (collectively, " Software") and

(v) related services, such as Membership programs that include special benefits for members, downloading and uploading media, forums, and additional features (together with Websites, Content, Games, and Software collectively referred to as "Service(s)"). For purposes of this Terms of Service, references to a "Service" include, unless the context requires otherwise, Content that is accessible by or used or available in the Service or that is applicable to the Service and the Software that facilitates the use of the Service.

You must provide at Your own expense the PC, Mac, mobile device, other equipment, Internet connections, and wireless service plans to access, receive, play and use the Services. USSURFS does not warrant, represent or guarantee that a Service will be accessible or useable on all equipment or with all wireless or Internet service plans.

Certain Services may require the creation of an account (" Account (s)"). To create an Account, You must have a valid email address and be eligible to use the Service for which You are registering. You must provide truthful and accurate information, and update such information to keep it true, accurate, current and complete. During the registration process, You may be required to create a password. USSURFS has the right to restrict, suspend, or terminate Your Account and refuse any and all current or future access to or receipt, purchase, play, or use of Services if USSURFS reasonably believes that such information is untrue, inaccurate, not current, or incomplete.

USSURFS requires You to be at least 18 years of age (or have reached the age of majority if that is not 18 years of age where You live) BEFORE You create an Account.

Some Services may require creation of a username (such as a "UserID", "Display Name", "Character Name" or "Team Name") to represent You in the Services, and which are tied to Your Account (collectively, "username(s)"). You may not select the name of another person, any third party's trademark, copyright, or other intellectual property, any name that could mislead other players to believe You to be an employee of USSURFS or affiliated companies, or any name that USSURFS deems in its sole discretion to be vulgar, offensive, hateful, misleading, or otherwise violates these Terms of Service. USSURFS reserves the right, in its sole discretion, (a) to delete or alter any usernames tied to an Account; and (b) to restrict, suspend or terminate Your access to or play or use of any Service or license granted to You, for any reason whatsoever, including, without limitation, any suspected or actual infringement of any trademark or trade name right, copyright, or other intellectual or proprietary right.

PHOTOSENSITIVITY WARNING. A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain visual images, including without limitation light patterns or flashing lights. Exposure to certain patterns or backgrounds on a computer, television or other screen, or while playing video games, may induce epileptic seizures or blackouts in these individuals. These conditions may induce previously undetected epileptic symptoms, blackouts, or seizures in persons who have no history of prior seizures or epilepsy. If You, anyone in Your family, or anyone in Your household, have an epileptic condition, have had seizures of any kind, or seizure symptoms, consult a doctor prior to using any of our Services. If You experience any of the following symptoms while using any of our Services, immediately discontinue use and consult Your physician before resuming use: dizziness, altered vision, eye or muscle twitches, jerking or shaking of arms or legs, loss of awareness, disorientation, confusion, any involuntary movement, or convulsions.

Any use, reproduction, modification or distribution of Services, including, but not limited to, Website, Content, Software, Games, or any other intellectual property not expressly authorized by these Terms of Service or by an authorized representative of USSURFS in writing is strictly prohibited.

Not all features, products, or Services offered or provided are available to all persons who try to register or in all geographic locations. USSURFS reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product, or Service to any person or geographic area.

Any offer for any feature, product or Service is void where such Services are prohibited. You are solely responsible for Your compliance with applicable laws with respect to the Services that You access, purchase, receive, play, or use.

Terms of Use

USSURFS operates advertising, branding, promotional Services where members view each others websites in order to get traffic to their own websites.

These are not a pyramid or ponzi schemes, they are not matrix programs or a "get rich quick" websites. Neither are they multi-level marketing programs.

Our Services are not paid to click, paid to read, paid to promote or paid to surf sites. The graphics, games, events and prizes provided by USSURFS may change at any time.

Members are not required to pay or buy anything to use or become an affiliate of any of our Services.

The content of the pages of our websites are for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on our Services for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on our Services is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through our Services meet your specific requirements.

Our Services contain material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms of Services.

All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the Services.

Unauthorized use of our Services may give rise to a claim for damages and/or be a criminal offense.

From time to time, our Services may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

Your use of our Services and any dispute arising out of such use of the website is subject to the laws of United States.

Email Verification & Subscription

If you agree to the Terms and register for a Service, you will receive an email with a verification link. You must click the verification link before you can start using the Service.

By joining a Service you agree to receive Newsletters, offers, and updates from USSURFS or the Service up to twice a day maximum, which you can opt-out from at any time. (This excludes any system notices you may receive automatically for inactive accounts etc.)

An account with any of our Services requires that the Member/User has an active email address. Unsubscribing from admin emails will result in the account going into deletion mode. Unsubscribed accounts are removed approximately 14 days after unsubscribing. Deletion is a non-reversible process and all account details including any advertising accumulated or referrals will be lost. You are able to re-subscribe and set your account back to active within the 14 day deletion mode period by logging in and visiting the profile page and then ticking the subscribed box. You will need to click the confirmation link in the email again when resubscribing.

Email you receive from us may contain private advertisements of a product or service not offered directly by USSURFS. As you opt in to receive these emails, remember they are not spam. So please do not report them as spam emails. False spam complaints will result in immediate deletion of your account(s).

Membership requires an active email address (One that actively receives our emails) and any email bouncing (Unable to be delivered to you) will result in the system automatically setting your account to inactive. When logging in it will ask you to provide a working email address to access the site. All we are able to do is send the email to you, the delivery of that email to your inbox by your email service provider is out of our control. Verification emails and lost password emails also fall under this category and if you are not receiving them you will need to provide an alternative email address.

Membership Account, Security, & Maintenance

Unless you received prior permission from USSURFS, you may only register for one account per Service. Members who sign up for multiple accounts will be suspended.

Only you may use your Service account. If someone else is using your account, it will be suspended. Family members and friends are welcome to make their own accounts, but sharing an account is absolutely a violation of our Terms.

USSURFS reserves the right to refuse, suspend or remove members for any reason without giving notice. This includes but is not limited to members who promote sites and services from our not allowed list and members who use frame breakers.

Users are completely responsible for the content they promote using a Service. Users are responsible for ensuring they have the rights to promote a URL, and any content it contains. USSURFS is not responsible if a user is in violation of another legal agreement, copyright infringement, or any other issues.

All promotional contests and bonus offering either set up manually or by an automated contest, bonus system is provided as a bonus only. We accept no liability over any lost prize/award or reward due to any interference with the contest system included and not limited to system timeout, system failure, users missing claim links or browsers not allowing system follow through for reward completion. In all contests/bonus rewards the managements decision is final. All bonuses/rewards are offered solely as a bonus and are not an entitlement of the member.

YOU MUST NOT:

• Republish material from our Services without prior written consent.
• Sell or rent material from our Services.
• Reproduce, duplicate, create derivative, copy or otherwise exploit material on our Services for any purpose.
• Redistribute any content from our Services, including onto another website.
• Resell advertising earned at any of our Services. This includes site views, banner ads or text ads.

Correction/Updating Personal Information

If a user's personally identifiable information changes, we provide a way to correct that user's personal data provided to us. This can be done within the Member Area usually on the profile page.

Right To Cancel

Users can cancel their membership at any Service and be removed from all newsletters, notices and databases. You can do this by using the link found at the end of system generated email messages from the Service, click that link and you will be taken to a web page where you may choose to be removed from just newsletters or the entire database.

If you decide to remove your account you relinquish any paid membership and/or downlines, unpaid commissions, and unused advertising credits instantly and cannot be recovered.

You can also easily manage removals and account deletion yourself by signing in and clicking the Delete Account button found on the profile/account details page. Self deletion of your account is immediate and will result in no further emails coming to you from the site after successful account deletion.

We are unable to delete an account for you unless you submit a support ticket using the email address that you used to register your account and confirm your username and current password. However, requesting deletion from us can take up to 7 days and you will continue to receive emails during that time.

Security

USSURFS takes every precaution to protect our user's personal information. When a user submits sensitive information via any of our Services, the information is protected both online and off-line. Only Service administrators can access personal information of the users.

If your account is compromised by someone gaining access to your email or password USSURFS cannot be held responsible for any loss of provided advertising services if someone else gains access to your account. We recommend you use a different password for each site you join to help avoid any issues.

Website/URL Rules (Not Allowed List)

USSURFS has the full right to delete any site that is inappropriate, questionable or gets a lot of complaints from other members.

Before submitting a URL to any of our Services, please read these rules very carefully and make sure your URL does not violate any of them. If you violate any of these rules, your site will be deleted along with any credits assigned to them. Your account(s) may also be deleted.

• No content promoting illegal or malicious activity under US, UK, or International laws.
• No content selling weapons or other state regulated items.
• No content with pages or substantial partial Text that is not written in English.
• No content with pop-ups, must click to close exit prompts, adf.ly or similar redirecting sites or frame-breaking sites.
• No viruses, trojans, spyware or that trigger anti-virus warnings.
• No auto installing/downloading software.
• No adult content. (including bad, foul or abusive language, or age specific access sites).
• No hate content. (including content that targets, threatens, or otherwise is hateful toward any race, ethnicity, gender or gender identity, sex, religion or other faith system or lackthereof, sexual orientation, age group, or disability or handicap).
• Rotators may be promoted only if all sites or banners in rotation comply with these terms.
• No Matrix sites, randomizers, cyclers or similar "get rich quick" schemes.
• No HYIP, pyramid, Ponzi schemes or "investment surf or any autosurfs".
• No PTP sites that violate our rules.

Paid-To-Promote Sites

You may advertise a Paid To Promote site as long as it follows the above rules. It must not load any other P2P sites, search sites, etc or have hidden content.

Traffic Co-ops & Rotators

You are free to promote free co-ops / rotators on one condition. You understand and agree that if we find multiple rotators being promoted inside your co-op link and / or it gets reported as a abusive site, it will be removed and all credits will be lost.

Service Teams

Team Leaders can decide who they let in to their team, whether to go private or public, and what kind of rules they want to impose. At any time, they can remove a member from their team.

At the end of each month the top 3 teams for the following categories will split the jackpot: "Top Overall Surfing", "Top Average Surfing" and "Top Referring".

In the event of a tie, the winnings for the category will be split between the number of teams that are tied for that spot.

Viewing Other Members Sites (Surfing) & Activity Policy

The use of programs or "bots" to automatically surf at any of our Services without clicking is strictly prohibited, and any member who is found using such a program will be suspended. This also applies to members who let someone else log into their account to surf.

Using several windows to surf faster than your timer allows or to save time is strictly prohibited, and any member who is found doing so will be suspended.

Falling below 85% accurate clicks will auto-suspend your account. If this happens and you're a new member and just started surfing, just send a ticket and I will fix it, but members who have surfed a lot will be suspended if this happens.

Surfing in a minimized window is not allowed and will cause a pop up at each click.

From time-to-time you may receive bonuses from different games and contest on this site, including Team Surfing, which can only be used for onsite purchases such as Account Upgrades or buying Advertising Credits. There are no cashout payments on these types of activities.

For free members, after 90 days of inactivity credits and impressions that are not assigned will be lost. Upgrading or surfing within 90 days will prevent loss in credits. Accounts older than 90 days will be "deactivated". You may "reactivate" your account at any time by logging in again.

FAILURE TO FOLLOW RULES

If your site or account fails to follow any of the rules listed in our Terms of Service, your account will be removed. All credits, impressions, commissions or rewards of any kind will be lost. Your banners and URLs will be removed, and your downline will be lost.

Spam

Spam is not permitted. If your account has been found to be sending spam, it will be removed without notice. You will not be able to sign up again.
You may not promote any of our Services in a way that could be considered spamming. You may only promote your referral URL and/or other promotional material in other traffic exchanges or advertising programs that allow it. Promoting a Service in a way that could be considered spamming will result in removal of your account and possible legal action.

CHAT, PM, and FORUM SPAM

USSURFS does not permit using the forum, chat, or private messaging system for sending advertisements. Members found using these services to send spam, ask users to join programs, bait members into asking for more information, or in any way using these services for promotion may find their access to the forum, PM system, and chat revoked. Repeated offenses will result account suspension and/or a permanent ban.

Acceptable Use Policy

You agree to use our Services only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the website. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content or disrupting the normal flow of dialogue within our website.

You must not use our Services to send unsolicited commercial communications.

You must not use the content on our Services for any marketing related purpose without our express written consent.

Restricted Access

We may in the future need to restrict access to parts (or all) of a Service and reserve full rights to do so. If, at any point, we provide you with a username and password for you to access restricted areas of a Service, you must ensure that both your username and password are kept confidential.

Revisions

USSURFS may change these terms from time to time and so you should check these terms regularly. Your continued use of our Services will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using our website immediately.

If any of these terms are determined to be illegal, invalid or otherwise unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

Limitation of Liability

THE MATERIALS AT THIS SITE ARE PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF INTELLECTUAL PROPERTY, OR FITNESS FOR ANY PARTICULAR PURPOSE. All terms and policies for that site/advertisement are the responsibility of the particular website or advertising owner directly.

USSURFS does not endorse the products or services being advertised by it's Members. It is your sole responsibility to perform due diligence before making a purchase or entering into any agreement with an advertising Member or a third party advertiser.

Governing Law

THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS LOCATED IN DENTON COUNTY, TX FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS AGREEMENT.

Purchases of Goods & Services

USSURFS uses third party payment processors for taking payments and we are not part of the Payment Processors company nor can we accept any loss or damage for their use. For this reason we do not store any payment info and all payments are collected via the processor and our scripts alerted to update your account.

If you have any issue with any purchase from USSURFS or any of our Services please submit a support ticket and we will try to work with you to come to a satisfactory conclusion. Initiating a chargeback, refund request, not as described or item not received dispute without first contacting us using our support desk and giving us 5 days to reply will result in immediate suspension of your account. Those are not ways to mutually resolve issues and should only be used as a last result for example awol admin for a long period of time. Having your account removed for breach of these terms may also result in the loss of your accounts at all sites associated with us as well as selected other sites that we work with to share false dispute information and bad practices.

Any special offers are for a limited time only and can be withdrawn from the system at any time. (including before any advertised offer end date if need be).

You agree that all details that you provide for the purpose of ordering or purchasing goods are correct, that any credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.

We reserve the right to hold or withdraw any payment you make to us if we are investigating your account with us for wrongful use.

We reserve the right to change upgrade benefits during the life of your upgrade. When we do this we do it to better the site and where possible we always try to improve the offer to upgraded members. However please note you are purchasing a upgraded account level and not any one benefit.

Please note: you are purchasing advertising services and not results. We cannot and do not guarantee any results from using our advertising, websites and services. All we can do is display your advertisements. It is up to you to provide the advertising content and offer services/products that sell in today's market environment.

Affiliate Commissions: cash payouts are only for purchases made by your direct referrals and subject to a holding period for verification of payment received on those purchases.

Refund Policy

We offer digital products. Delivery of Your purchased product will be deemed delivered when it appears in your account, thus there are NO REFUNDS offered. If You are not happy with any of our products, contact us through the support system.

Buying another type of upgrade before Your current upgrade runs out will not make you eligible to get a refund or prorated refund for the current one.

Should You choose to delete your account while still having an active upgrade, You will not be able to get a refund. It is not possible for you to delete Your account by mistake or by having Your account hacked into and deleted by another person (see the bottom of Profile in the navigation menu for information on how to delete your account).

Should You start a new account after deleting your old upgraded account You can not transfer the previous upgrade to the new account.

It is Your responsibility to cancel any active upgrade subscriptions in Your payment processor account before the payment processing date if You chose not to continue Your upgrade or paid subscription. Commissions are instantly transferred to Your upline, so if you forget to cancel Your subscription, You cannot request a refund.

If You use e-checks, bank transfers or other payment methods that fail or bounce, Your Account will be stripped of all earnings and You may be suspended.

Cash signup bonuses, if any, not used or cashed out within one year will be forfeited.

Site & Service Updates

We may send the Member/User service announcements updates. We communicate with the users to provide requested services and in regard to issues relating to their accounts via email. We may also include promotions of third party products or services.

Change Notice

Any changes made to Terms and/or Policies will be binding to all members. Please be advised that some Terms may be revised due to changes in the industry and/or with changes in terms and policies of payment processors.
